Terms of Service

Welcome to Como. These Terms of Service (“Terms”) govern your access to and use of our mobile applications, websites (including trycomo.app), and related services (collectively, the “Service”). By creating an account, downloading our app, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy describes how we collect and use personal information. It is incorporated into these Terms by reference.
1. Who may use Como
You must be at least 18 years old (or the age of majority where you live) to use the Service unless we expressly permit otherwise in writing. By using the Service, you represent that you meet this requirement and that any information you provide is accurate.
Como is not intended for children under 13. We do not knowingly collect personal information from children under 13. See our Privacy Policy for how to contact us.
2. What Como is — and what it is not
Como is a digital companion intended to support a healthier relationship with food and emotional well-being.
Como is not medical or clinical care. Nothing in the Service is a diagnosis, treatment, or substitute for qualified professional health advice (including from physicians, therapists, dietitians, or other licensed professionals). Always seek advice from qualified professionals regarding health questions.
Emergencies: If you or someone else may be in danger or experiencing a crisis, contact local emergency services or a crisis hotline immediately. Do not rely on the Service in an emergency.
3. Artificial intelligence
Certain features use artificial intelligence (“AI”). AI-generated content may be inaccurate, incomplete, or inappropriate. You are responsible for how you interpret or act on outputs. Use your judgment and qualified professionals where needed.
Before your content may be processed by AI providers acting on our behalf, we may obtain your consent in the app, as described in our in-product disclosures and Privacy Policy.
4. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly at trycomoapp@gmail.com if you suspect unauthorized access.
You may delete your account in the app (where supported). Subscription management for purchases made through Apple is handled according to Apple’s rules in addition to these Terms.
5. Subscriptions and payments
If we offer paid features or subscriptions:
- Fees, renewal terms, and cancellation options will be presented at purchase and may be summarized in-app.
- Payments processed through the Apple App Store are subject to Apple’s terms and billing policies.
- To the fullest extent permitted by law, refunds are governed by Apple and applicable law unless we expressly state otherwise.
6. Acceptable use
You agree not to:
- Use the Service in any unlawful way or in violation of applicable regulations
- Attempt to scrape, interfere with, overwhelm, reverse engineer, or breach the security or integrity of the Service
- Upload malware or content that violates others’ rights
- Misrepresent your identity or harass, abuse, or harm others while using features that permit interaction
- Use the outputs of the Service to develop competing models or systematically extract underlying models or prompts in violation of applicable terms
We may suspend or terminate access if we reasonably believe these rules are violated or if necessary to protect users or operate the Service.
7. Content and intellectual property
We retain all rights to the Como name, logo, branding, software, designs, documentation, and other materials we provide. Subject to these Terms, we grant you a limited, personal, revocable license to use the Service for its intended purpose.
You retain rights in content you submit. You grant us a license to host, store, process, encrypt, transmit, and display such content solely to operate, secure, debug, improve, and provide the Service, as further described in the Privacy Policy.
8. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, error-free, or suitable for every user or situation.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMO AND ITS TEAM, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
10. Indemnity
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Como and its team and affiliates from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your breach of these Terms, or content you submit through the Service.
11. Changes to these Terms
We may modify these Terms from time to time. If changes are material, we will provide notice as appropriate (such as updating the effective date and, where reasonable, notifying you in the app). Your continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the Service and delete your account where available.
12. Governing law
Unless applicable law requires otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, and any dispute shall be resolved in state or federal courts located in California, unless you have a non-waivable right to adjudicate disputes elsewhere under applicable consumer law.
13. Miscellaneous
If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, corporate reorganization, or sale of assets.
